NOVA duplicates calls but isn’t breaking any laws

An Australian radio network has been described as downright dishonest for editing a winner call to make them appear more local than they are.

ABC’s MediaWatch show – a weekly look at what’s happening on radio and TV in Australia – highlights how presenter Greg Burns talks to a caller to give away concert tickets in Sydney, then plays out the same caller with local references in Melbourne.

A video (embedded below) shows one caller winning the same prize twice, in two different places.

Here’s the phone call as aired on Nova in Sydney:

Greg Burns: let’s get somebody sorted for some ANZ Stadium tickets for Adele, live in Sydney. Live in Little Bay, Hello Brad.

Brad Plokhooy: Hey, how are ya?

Greg Burns: I’m well, how are you today lapping up that Sydney sunshine?

Brad Plokhooy: I am super excited, I’m lapping it up, lapping, I’ll be lapping even more if I’ve got these tickets …

Greg Burns: Brad, consider it our gift to you. You’ve got your tickets. You’re going as Nova’s guest to Adele live.

And here’s the same caller played out in Melbourne:

Greg Burns: Right let’s sort somebody out for some Etihad Stadium tickets for Adele live … Hello Brad Plokhooy.

Brad Plokhooy: Hey, how are ya?

Greg Burns: I’m well, it’s a hot one today. Are you lapping up that Melbourne sunshine?

Brad Plokhooy: I am super excited, I’m lapping it up, lapping, I’ll be lapping even more if I’ve got these tickets …

Greg Burns: Brad, consider it our gift to you. You’ve got your tickets. You’re going as Nova’s guest to Adele live.

ABC provides other examples of the competition winners being syndicated, and asked the authorities if the station is breaking any laws in doing so. Nobody can provide an answer.

Here’s the response from NOVA about the findings:

NOVA Entertainment runs its listener competitions in adherence to a strict process set out formally in the competition terms and conditions. These terms and conditions are lodged with the relevant authorities, including the liquor and gaming authority and clearly set out the prizes available, the states in which the competition is running and how to win. The terms and conditions are freely available to listeners on the relevant NOVA Entertainment websites or on request at the stations.

NOVA prides itself on giving listeners the opportunity to win prizes and experiences and conducts its competitions with the utmost integrity. Any suggestion of a ‘duplication’ of winners is completely false and baseless. Where competitions are run across multiple states, listeners in each state are given equal chances to win such prizes. Any on air replay of a winner receiving a prize is for promotional purposes and does not reduce the number of prizes available to win or actually given away.

NOVA is careful to comply with its broadcasting and consumer law obligations and views these obligations very seriously at all times.
